EB-1 — the first-preference immigration category

EB-1 is the first-preference immigration category in the USCIS system. Unlike most work visas, EB-1 requires no labor certification (PERM) and has no per-country backlog. about the EB-1 Green Card

Can I file an EB-1A petition while living outside the United States?

Yes. You do not have to be in the United States to file the petition. A licensed U.S. immigration attorney can prepare and file it with USCIS on your behalf. If USCIS approves the petition, you can attend an interview at an available U.S. consulate, receive an immigrant visa, and enter the United States as a lawful permanent resident under the rules in effect at that time.

Do I need a degree for EB-1A?

No. A university or field-specific degree is not a mandatory EB-1A requirement. The central issue is whether the evidence establishes extraordinary ability, satisfies the USCIS criteria, and shows sustained recognition in your field.

Does Premium Processing speed up the Green Card itself?

Not always. Premium Processing speeds up USCIS action on the petition only. It does not shorten consular processing, immigrant-visa issuance, or production of the physical Green Card. Faster petition review is also not always the best strategic choice. Some applicants receive Requests for Evidence or denials even with strong cases. When there is no urgent deadline, standard processing may provide a more suitable review timeline.

How should I respond to an EB-1 Request for Evidence?

A Request for Evidence (RFE) is not a denial. Review every USCIS concern, strengthen the evidentiary record, and submit a complete response by the stated deadline. A well-prepared response can still lead to approval of the petition.

Can I use Russian-language publications and documents?

Yes. USCIS accepts documents and publications in Russian and other foreign languages, but every non-English document must include a complete English translation that meets USCIS requirements.

Can an entrepreneur qualify for EB-1A without a patent?

Yes. A patent is not a mandatory EB-1A requirement. Entrepreneurs may document extraordinary ability through company results, media coverage, professional awards, speaking engagements, professional memberships, high compensation, significant contributions to the industry, and other qualifying evidence.

How is EB-1A different from EB-2 NIW?

EB-1A is designed for professionals with extraordinary ability and often offers a faster Green Card route. EB-2 NIW is for highly qualified professionals whose proposed work has national importance to the United States. EB-2 NIW generally has a lower evidentiary threshold, but the overall timeline may be considerably longer and can extend for several years.
